Privacy and cookie usage notice for website visitors

1. Introduction

1.1. This Privacy and Cookie Usage Notice (hereinafter – the Notice) provides information on how AB “KN Energies”, legal entity code 110648893, registered office address Burių g. 19, Klaipėda, email: info@kn.lt (the Data Controller or the Company), processes the personal data of visitors (Visitors) to its website (www.knenergies.lt).

1.2. The Company processes Visitors’ personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – GDPR), and other applicable data protection legislation.

1.3. This Notice applies only to AB “KN Energies”.

2. Purposes and scope of personal data processing

2.1. Below is information on what personal data of Visitors is processed by the Company and for what purpose.

  • For website administration and improvement: IP address, region from which the site is accessed, address of the Company’s website visited, most frequently read content on the site, browser and device type and version, operating system type and version, language preferences, website visited before accessing the Company’s site, time spent browsing pages, login time and other statistical data.
  • For ensuring cybersecurity and protection of confidential information: IP address.

3. Retention period of personal data

3.1. Visitors’ personal data collected via Google Analytics is retained for no longer than 24 months.

3.2. Longer retention than stated in this Notice may occur only when:

  • There are reasonable suspicions of unlawful activity under investigation;
  • Visitor data is necessary for resolving a dispute or complaint;
  • Other grounds provided by law apply;
  • It is necessary to enforce or defend legal claims and/or protect the rights of Visitors or others, or for reasons of public interest.

4.1. The following are the legal grounds for processing personal data:

  • Visitor’s consent;
  • Legal obligation (a statutory requirement necessitating personal data);
  • Legitimate interest of the Company.

5. Sources of personal data

5.1. Personal data about Visitors is collected directly from them when they visit www.knenergies.lt and/or consent to cookies. Statistical data is collected using the Google Analytics tool.

6. Transfer of personal data to third parties

6.1. Visitors’ personal data may be transferred to:

  • Service providers involved in website development, improvement and administration, who help ensure smooth and uninterrupted website operation and protection against cyberattacks, as well as providers of website analytics services;
  • Authorized institutions and other entities entitled to receive data under the laws of the Republic of Lithuania, including those specified in the Law on Cybersecurity, the Law on the Protection of Objects Important for National Security, and the Law on the Prevention of Corruption.

7. Visitor rights

7.1. As data subjects, Visitors have the following rights:

  • To be informed about the processing of their data (right to know);
  • To access their data and understand how it is processed (right of access);\
  • To request correction or supplementation of incomplete data (right to rectification);
  • To withdraw consent for data processing when based on consent (right to withdraw consent);
  • To request deletion of personal data (right to be forgotten);
  • To request restriction of data processing (right to restrict processing);
  • To object to data processing carried out in the public interest or based on legitimate interests (right to object);
  • To receive their data in a structured, commonly used, and machine-readable format and transfer it to another data controller (right to data portability);
  • To submit complaint to the State Data Protection Inspectorate.

8.1. Cookies are text files stored in the browser of a device (e.g. computer, mobile phone, tablet) when a Visitor browses the website, collecting information about their browsing behavior.

8.2. Essential cookies – these cookies are necessary for the Visitor to browse and use the website’s features. Without them the website would not function properly, so they are activated immediately upon visiting the site.

9.1. All personal data which is accessed through the company’s social network accounts (including messages, use of the “Like” and “Follow” fields in the social network account, etc.), managed by the respective social network service provider. 10. Implementation of Visitors’ personal data rights

10.1. Regarding the processing of Visitors’ personal data by the Company, a Visitor may fill out the form provided on the Company’s website or submit a free-form request. The request can be submitted in person at the Company’s office at Burių g. 19, Klaipėda, or sent via email to info@kn.lt.

10.2. When contacting the Company about the processing of their personal data, the Visitor must verify their identity by presenting a personal identification document (if visiting the office in person) or by signing the request with a qualified electronic signature.

10.3. The Company commits to reviewing all received requests and indicating what actions were taken to fulfill the rights specified in the request within one (1) month. Depending on the complexity and number of requests, this period may be extended by an additional two (2) months. The Company is obligated to inform the Visitor about the extension of the review period within one (1) month from the date of receiving the request.

10.4. The Company has the right to refuse to fulfill a Visitor’s request if Visitor’s identity cannot be verified, request is repetitive or fulfilling the request would require disproportionate effort or is impossible to implement.
